Our policy on refunds and cancellations for web development services.
At PK ENTERPRISE, we strive to deliver high-quality website design and web development services. This Refund Policy outlines the terms and conditions under which refunds may be issued for our services. Please read this policy carefully before engaging our services.
1. General Refund Policy
Refunds for web development services depend on the project stage, work completed, and mutual agreement between PK ENTERPRISE and the client. Due to the custom nature of web development work, refunds are evaluated on a case-by-case basis according to the guidelines outlined below.
2. Project Deposit
A project deposit may be required to initiate work. The deposit covers initial consultation, project planning, and resource allocation. Deposit refund eligibility:
- Before work begins: If the client cancels before any work has commenced, the deposit may be refunded after deducting administrative costs (up to 10% of the deposit amount).
- After work begins: Once design or development work has started, the deposit becomes non-refundable as it compensates for time and resources already invested.
3. Refunds Based on Project Stage
Refund amounts are determined by the stage of project completion:
- Consultation Phase (0-10% complete): Up to 70% of payments made may be refunded, minus the non-refundable deposit and any third-party costs incurred.
- Design Phase (10-40% complete): Up to 40% of payments made may be refunded, reflecting the design work completed.
- Development Phase (40-80% complete): Up to 20% of payments made may be refunded, reflecting substantial work completed.
- Final Phase (80-100% complete): No refunds are available as the project is substantially or fully completed.
- After Delivery: No refunds are available once the final website has been delivered and approved by the client.
4. Non-Refundable Items
The following are non-refundable under all circumstances:
- Third-party costs including domain registration, hosting fees, SSL certificates, premium themes, plugins, or stock assets purchased on behalf of the client
- Work that has been completed, delivered, and approved by the client
- Rush or expedited service fees
- Consultation fees for completed consultation sessions
- Maintenance and support fees for periods already served
- Payment gateway setup fees once integration work has begun
5. Cancellation by Client
If the client wishes to cancel a project:
- Written cancellation notice must be sent to mr.technicalpawan@gmail.com
- Payment for all work completed up to the cancellation date is due immediately
- Refund eligibility will be assessed based on the project stage at the time of cancellation
- Partial deliverables (design files, code) will only be provided after settlement of all outstanding payments
- Cancellation does not waive the client's obligation to pay for work already performed
6. Cancellation by PK ENTERPRISE
We reserve the right to cancel a project if:
- The client fails to make agreed payments within the specified timeframe
- The client provides false or misleading information
- The client requests work that is illegal, unethical, or violates third-party rights
- There is a breakdown in communication after reasonable attempts to resolve issues
In such cases, the client is responsible for payment of all work completed. Any eligible refund will be processed as per the project stage guidelines above.
7. Mutual Agreement
In cases where standard refund guidelines do not apply, both parties may reach a mutual agreement on refund terms. Such agreements must be documented in writing (email is acceptable) and signed off by both Pawan Kumar (on behalf of PK ENTERPRISE) and the client.
8. Refund Processing
Approved refunds will be processed as follows:
- Refund requests must be submitted in writing to mr.technicalpawan@gmail.com
- Refund requests will be reviewed within 7 business days
- Approved refunds will be processed within 14 business days of approval
- Refunds will be issued to the original payment method used
- Bank transfer refunds may take additional 3-5 business days to reflect
9. Dispute Resolution
If you disagree with a refund decision, you may request a review by contacting us with detailed reasons for your dispute. We are committed to fair resolution and will work with you to reach an amicable solution. If a resolution cannot be reached, disputes shall be subject to the jurisdiction of courts in Sikar, Rajasthan, India, as outlined in our Terms & Conditions.
10. Satisfaction Guarantee
We are committed to client satisfaction. If you are not satisfied with our work during the revision phase, we will make reasonable efforts to address your concerns through additional revisions (within the agreed scope). Refunds are considered only when satisfactory resolution through revisions is not achievable and both parties agree.
11. Changes to This Policy
We reserve the right to update this Refund Policy at any time. Changes will be posted on this page with an updated date. The policy in effect at the time of project agreement will apply to that specific project.
